Resumo: According to the Quality Parameters for Early Childhood Education, produced by the Ministry of Education in 2006, children need space for their best development in each stage of their growth and when there is overcrowding this development is compromised. The day care centers in the municipality of Treze Tílias follow the curricular parameters established by the guidelines of the National Curricular Base, adapting according to the laws in force, where each room is divided by age and quantity of children allowed by the legislation. Given this, it is the general objective of the study to investigate how the demand, the vacancies, the waiting list and the operation of the municipal daycare centers of Thirteen Tílias are. In order to facilitate the development of the work, a documentary study was carried out, with the current legislation on the demand for vacancies at the national level, a case study, interviews with the heads of the municipal units of the municipality, data collection and analysis comparing the data presented by the directors on the situation in Trezetiliense municipality. In this way, it was verified that there is much to be done regarding the application of municipal public resources to improve the waiting list in the municipality. As data collected the waiting list that is in progress even though it is minimal, it exists, and does it mean that not everything being proposed is being implemented in practice, or is it actually being made effective because there is a waiting list?
