The difference between enforcement against particular and enforcement against Treasury is easily observed as parameter unseizability aspects such as public goods, and processing of the constitutional public debt payment. The main framework for the institutionalization of the system of public debt payment was his elevation to constitutional status with the advent of the 1934 Constitution, from that moment appeared numerous innovations aiming to remedy the inconvenience to the payment of debts arising from final decisions. The legal system has evolved into issues such as transparency when you created the need to respect the chronological order, has also evolved to provide for sanctions such as kidnapping, intervention, discharge power, the accountability of agents of responsibility for crimes. The author aware of the pros and cons of an execution against the Treasury has addressed this dialectic in the historical evolution of the public debt payment, its current constitutional profile established by Constitutional Amendment No.62/2010, in order to draw a line can help policy makers understand this subject as controversial. Este trabalho teve como temática um prospecto da evolução do direito no campo das Execuções contra a Fazenda Pública, valendo-se de bibliografias para relatar toda evolução histórica e teórica do instituto. O diferencial entre a execução contra o particular e a execução contra a Fazenda é facilmente observado tendo como parâmetro aspectos como a impenhorabilidade de bens públicos, e a tramitação constitucional dos precatórios. O principal marco para a institucionalização do regime de precatórios foi sua elevação ao status constitucional com o advento da Constituição de 1934, a partir desse momento inúmeras inovações com intuito de sanar os transtornos para o pagamento das dívidas oriundas de decisões transitadas em julgado. O ordenamento jurídico evoluiu em quesitos como a transparência quando criou a exigência do respeito à ordem cronológica, evoluiu também ao prever sanções como o sequestro, a intervenção, o poder liberatório, a responsabilização dos agentes em crimes de responsabilidade.
