In this sense, this study guides the following research problem: how ZEIS - Special Zones of Social Interest can be instruments of access to citizenship through the right to housing in the context of Diadema - SP? Therefore, we defined the general and specific objectives. General objective of the study is to analyze the system design and implementation of the Law of ZEIS establishing relationships with the access to citizenship through the right to housing in the context of Diadema - SP. As for specific goals, they were so specified: - Characterize the system of drafting the Law ZEIS; - Identify the deployment process of the municipality ZEIS study. In terms of justification, one must consider that the ZEIS can be considered as an instrument of urban policy management, reinforcing the decision to urbanize slums, and focusing on the process land. Thus, were made public policies directed to the accommodation and care of these needs, and, therefore , we want to demonstrate the relevance of citizenship and the main focus of the application of the Act, within the historical factor, when it is approved in the Master Plan 1994 when he was deployed as an instrument of regulation and slum upgrading, acting in the demarcation of areas empty private, for implementation of projects for social housing, enforcing the principle of the social function of property. O presente trabalho tem por temática a cidadania e o direito à habitação a partir das áreas especiais de Interesse Social. Neste sentido, orienta o presente estudo o seguinte problema de pesquisa: como as ZEIS – Zonas Especiais de Interesse Social podem ser instrumentos de acesso à cidadania por meio do direito à habitação, no contexto do Município de Diadema - SP? Para tanto foram definidos os objetivos gerais e específicos. Como objetivo geral o estudo pretende analisar o sistema de elaboração e implantação da Lei de ZEIS estabelecendo relações com o acesso à cidadania por meio do direito à habitação, no contexto do Município de Diadema - SP. Quanto aos objetivos específicos, os mesmos foram assim especificados: - Caracterizar o sistema de elaboração da Lei de ZEIS; - Identificar o processo de implantação da ZEIS no município em estudo. Em termos de justificativa, é preciso compreender que as ZEIS podem ser consideradas como um instrumento de gestão da política urbana, reforçando a decisão de urbanizar as favelas, e, focando o processo fundiário. Desse modo, foram feitas políticas públicas que direcionaram para a acomodação e atendimento dessas necessidades, e, sendo assim, queremos demonstrar a relevância da cidadania e o foco principal da aplicação da Lei, dentro do fator histórico, quando de sua aprovação no Plano Diretor de 1994, quando foi implantada como instrumento de regularização e urbanização de favelas, atuando na demarcação de áreas vazias particulares, para implantação de projetos de habitação de interesse social, fazendo valer o princípio da função social da propriedade. 2020-11-25T18:04:20Z 2020-11-25T18:04:20Z 2014-03-28 specializationThesis TAVARES, Eduardo Jorge.
