This work aims to present a public policy under discussion in many municipalities of our country: land regularization and the impacts of the new legal framework. It contextualizes the issue of the right to housing and urban expansion, brings the discussion of land regularization and current legislation. The discussion on urban land regularization should be a priority on the part of the Public Power, especially in view of the Brazilian reality of disorderly and informal growth of cities. From the constitution of 1988, which sought to give directions to the problem of land regularization, thus becoming a public policy that seeks to ensure the right to housing, housing, sustainable development, among others. It indicates the main points of the new paradigm of land regularization, as well as the main criticisms. The methodology used for the production of the work was bibliographic and documentary research, with a case study of the Legal Home Program of the State of Santa Catarina, using national legal doctrine books, scientific articles, as well as books from other areas of knowledge because it is a broad theme that involves several aspects. The research showed that the public administration needs to understand that the process of land regularization should guide the Public Administration in the process of wealth management. Policies that actually promote the right to housing should be prioritized, with a main focus on urban land regularization of social interest. When it comes to the Legal Home Program many families have already been contemplated, but there is a long walk for the participation to be in many other municipalities of the state. |
