The main motivation for addressing this issue is the concern about how the process of punishment occurs to adolescents who are in a situation of non-conformity with the law, without often taking into account the cause and effect relationship between the commitment of crimes and the social condition in which they live. Based on the historical analysis of the treatment directed at children and adolescents who may have committed some infraction, there is a legitimacy of violence as a form of resocialization, which violates the basic rights established by the Statute of the Child and Adolescent. Although there have been changes in relation to the understanding of the adolescence phase as a determinant for the formation of the subjectivity of the individual, and consequently the reformulation of pedagogical guidelines aimed at resocialization, the spaces that shelter the socio-educational institutions still maintains elements that refer to the old punitive culture, such as walls, grids, littlevisual permeability and constant vigilance. Understanding architecture as an essential tool in the conditioning of sensory behaviors and perceptions, an adequate physical space is of utmost importance for the resocialization of these adolescents in order to guarantee their rights and provide new opportunities and perspectives for the future. A presente pesquisa tem como objetivo o embasamento teórico-técnico para a elaboração do projeto do Centro de Ressocialização para adolescentes em conflito com a lei, na cidade de Curitiba/PR, a partir da análise dos motivos que levam os adolescentes a cometerem atos infracionais, e a estrutura social em que estão inseridos. A principal motivação para a abordagem deste tema é a inquietação em relação ao processo de punição a adolescentes que se encontram em situação de desconformidade com a lei, que ocorre muitas vezes sem levar em conta a relação de causa e efeito entre o cometimento de delitos e a condição social em que vivem. A partir da análise histórica do tratamento direcionado à crianças e adolescentes que, porventura, tenham cometido algum ato infracional, nota-se uma legitimação da violência como forma de ressocialização, o que fere os direitos básicos instituidos pelo Estatuto da Criança e do Adolescente. Embora tenham havido mudanças em relação ao entendimento da fase da adolescência como determinante para a formação da subjetividade do indivíduo, e por conseguinte a reformulação de diretrizes pedagógicas que visem a ressocialização, os espaços que abrigam as instituições de socioeducação ainda mantém elementos que remetem à antiga cultura punitiva, como muros, grades, pouca permeabilidade visual e constante vigilância.
