This article has as scope the power of environmental police in the face of the practice of acts and omission of facts in the administrative conduct. With the objective of presenting some elements of the environmental police power in case of omissive conduct of the public administration. For this purpose, the methodology of documentary analysis and case study of the eminent situation of environmental irregularity of the municipal dump of Teófilo Otoni-MG. As a result, it has been observed that for some time Teófilo Otoni has been warned of the illegal disposal situation of urban solid waste, neglecting the fact and incurring in many illicitudes, thus responding to the civil action proposed by the Minas Gerais Public Prosecutor General, ordered to comply, under pain of a fine, with all the prerogatives of the proposed actions. Finally, observing the excessive delays of public power in the exercise of environmental police power as a result of omissive conduct on the part of the municipal public administration. |
