With the objective of presenting some elements of the environmental police power in case of omissive conduct of the public administration. For this purpose, the methodology of documentary analysis and case study of the eminent situation of environmental irregularity of the municipal dump of Teófilo Otoni-MG. As a result, it has been observed that for some time Teófilo Otoni has been warned of the illegal disposal situation of urban solid waste, neglecting the fact and incurring in many illicitudes, thus responding to the civil action proposed by the Minas Gerais Public Prosecutor General, ordered to comply, under pain of a fine, with all the prerogatives of the proposed actions. Finally, observing the excessive delays of public power in the exercise of environmental police power as a result of omissive conduct on the part of the municipal public administration. O presente artigo tem como escopo o poder de polícia ambiental em face da prática de atos e omissão de fatos na conduta administrativa. Com o objetivo de apresentar alguns elementos do poder de polícia ambiental em caso de conduta omissiva da administração pública. Utilizando para tal, a metodologia de análise documental e estudo de caso da situação eminente de irregularidade ambiental do lixão municipal de Teófilo Otoni- MG. Como resultado, observou-se que há tempos o município de Teófilo Otoni vem sendo advertido da situação ilegal de disposição final dos resíduos sólidos urbanos, negligenciando o fato e incorrendo em inúmeras ilicitudes, respondendo, portanto, a ação civil proposta pelo Ministério Público de Minas Gerais, condenado a cumprir, sob pena de multa, todas as prerrogativas das ações propostas. Observando, por fim, uma excessiva morosidade do poder público no exercício do poder de polícia ambiental em decorrência de conduta omissiva por parte da administração pública municipal.
