Resumo: This study aims at analyzing the situation of early childhood education in Brazil from the 1990s, this period marked since its institutionalization as a character education in the care of children from birth to five years old. Based on definitions about Public and Social Policies that influence the organization and attendance in kindergarten, as well as support discussions on early childhood education in policy scenario, because this stage of education is consolidating itself as a public policy, initially from Federal Constitution of Brazil in 1988, which triggered this 1990's new laws that operationalizes and organizes and establishes the collaboration and organizing education systems in the Union, States, Federal District and Municipalities. And finally, we seek dialogue with authors who have been reflecting and discussing the history of education, early childhood education and its policies, then to discuss the progress and development of these educational policies that will serve the interests of the emerging class because they are subordinate the global system of production and the social division of labor.
