Resumo: This study had the irregularity land from the town named Torre de Pedra as the main theme, mainly due to the national problem regarding the issue of unplanned urban expansion in Brazilian cities due to rural exodus started in the 80s, which caused a situation of numerous irregular settlements lands in almost all Brazilian cities. The Federal Constitution of 1988 shows up as important mark on the legislation about Urban Policy and the need of regularization for these lands, treating this issue as a matter of public policy and eminent importance for Brazilian cities. The article was regulated by the City Statute in 2001 that brought numerous regularization instruments. Subsequently, the Law n. o 11.977/09 brought a specific chapter to treat the land settlements regularization located on the urban areas. In Torre de Pedra, most properties located in the urban area are irregular and most of them lack proper documentation and property registration. The population of the city, following the national standard, has a higher concentration in the urban area. Because of the number of habitants, Torre de Pedra has not Master Plan and the only law dealing with the property subject is related the Subdivision and Urban Land Use, that’s why it is extremely important that the subject is regulated by the municipal government, because after all, the urban policy development is a city duty. Finally, the analysis of this research also attempts to how the city has managed these irregularities and which measures have sought for buildings regularization in the urban area of Torre de Pedra, if it used and applied the instruments provided by the City Statute and the Law n. o 11.977/09 seeking to guarantee the right to housing of the population.
