This work had as its theme the criminal liability of legal entities in environmental crimes relating to various controversies. And because it's a subject that brings in its essence divergences, encouraged this research. The topic under discussion already has support in our legal system, establishing himself in art. 225, paragraph 3, of the Constitution as well as in Law No. 9.605/98 - Environmental Crimes Law. The discussion stems precisely from the entity being devoid of personality, ie, unable to express will, therefore, not able to practice behavior that generates effects in criminal cases, the will is an essential requisite culpability. We also intend to analyze the distortions between the figures and the reality of municipal environmental management in Brazil. |
