Resumo: The objective of this research was to analyze compliance with the Transparency Law and the Access to Information Law by the Municipality of São Bernardo do Campo / SP through its website. As for the methodology, it was based on a descriptive study elaborated from the legal aspects that deal with the theme and with the application of a model of observation protocol that assesses the level of transparency in the electronic portals of municipal public management. It is an instrument developed by a joint action between recognized public agencies of external control of the Federal Government and the State Government of Tocantins that lead the official institutional initiatives for policies of transparency, fight against corruption and defense of the public patrimony. The result was a checklist with 70 legally mandatory items taken essentially from the Fiscal Responsibility Law (LRF), Transparency Law and Access to Information Law (LAI). The instrument was adapted to the proposal of this work – which is the evaluation only by navigation to the official website -, having excluded 20 questions that cannot be evaluated through internet access. The result was a checklist with 50 items of mandatory content. Data collection was carried out by visiting the electronic portal of transparency of the investigated municipality, where the collection of information resulted from the application of the proposed observation protocol. The result obtained with the analysis of the collected data indicates that the municipality reached a level of classification “BOM”, that is, the federated entity reached a high degree of compliance with legal determinations, highlighting the ease of obtaining relevant information to the local citizen. The Transparency Portal is organized, with good usability for the citizen and offers a support system that meets the minimum standards necessary for the user to request information of interest. However, despite the positive results achieved by the portal under analysis, there are still negative points related to the lack of information that needs to be improved and require greater attention from the Municipal Government, such as: budget and public finances, annual accountability, public contracts (public tenders) ), among others.
