Resumo: According to ANVISA Erva-Mate and the product formed exclusively by the leaves and branches, of the varieties of Ilex paraguariensis, in whole or milled obtained through the drying process and fragmentation, intended for the preparation of chimarão or terere. They were evaluated in the present study thirty-five samples of mate in the States of Parana, Santa Catarina and Rio Grande do Sul, with the objective of analyzing the packaging if all were in agreement with the existing legislation, and should be included as mandatory items the popular name and scientific, instruction for preparation of form clear and record in IBAMA, is not allowed any information that assign drug indications and/or therapeutic, in direct or indirect way. Also was checked items not required as, registration at the Ministry of Health, information regarding minimum and maximum and nutritional facts. Among the samples of mate all were in agreement in relation to scientific name should appear properly on packaging and instruction for preparation of form clear, and three samples will provide information regarding the medication instruction, as the record in IBAMA 31% of the samples were in disagreement.
